This Site as a whole, and its content, jewellery and material, are protected by copyright, trademark, registered design and other intellectual property rights and are the exclusive property of DJ.

Neither the content nor any portion of the Site may be used, reproduced, duplicated, copied and sold, accessed, modified or otherwise exploited, in whole or part for any purpose without our express prior written consent.

Not all DJ products are shown on this Site and other styles and designs may be available in our stores. Not every product shown is available in every DJ store. The style and design of all DJ products shown in this Site may be changed without any notice and prices are subject to change. We have made every effort to display accurately the detail of the products depicted on this Site. However, we cannot guarantee that the actual design and detail is displayed by your monitor accurately.

Collection of Personal Information
DJ will only collect Personal Information where the information is necessary for DJ to perform one or more of its functions or activities. DJ collects personal data from visitors to the website who register the information or use our online purchasing facility. We also use cookies (as described below and track IP addresses so that we can improve our services and enhance your DJ experience). In addition, DJ collects some protected and personal information (example, name, address, telephone numbers, credit card information, email addresses etc) from our customers who submit customer information at one of our stores or on our website, enter into a promotion, from affiliated companies and, on occasion, from unrelated third parties. To serve you better we may combine information you give us with other information which is publicly available.

DJ uses appropriate security measures to protect the information provided to us. However, while we take reasonable steps to protect this personal information from unauthorised access, use or disclosure, you accept that no internet data transmission can be guaranteed to be secure from access from unintended recipients and will not hold us responsible for any breach of security unless this breach is due to our negligence.

Placing Orders
Orders will not be dispatched until full payment has been received by Dracakis Jewellers. Without limiting the operation of any other Terms herein, DJ is not responsible for any loss or damage caused by late delivery or cancellation of an order or a product. Placement of an order by you constitutes an offer to enter into an agreement with DJ ("your offer"). You will be emailed an order confirmation for the sole purpose of confirming the details of your offer. Please note, that the order confirmation does not constitute an acceptance of your offer or reflect the status of your order in any way.

Cancellation of Orders
If you need to cancel an order, please contact us immediately on 02 9969 4152. Our agreement with the purchaser only comes into existence once we have confirmed your order and your payment has been made and processed in full. Once we have accepted payment for an order, cancellation of the order is within our sole discretion. Orders that cannot be cancelled will be subject to our terms and conditions relating to in this policy.

Delivery
It is the obligation of the purchaser to enter the correct delivery address details at the time of ordering. Should you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense.

We will provide you with an estimated date for delivery. While we make every effort to deliver by this time, all dates specified are estimates only.

It is the responsibility of the customer to inform DJ if an order does not arrive. Once we have been informed an order has not arrived by the due date, we will lodge enquiries with the courier to ensure delivery occurs as soon as possible. We will not be held liable for any loss or damage resulting from late delivery.

Please note that if an item has been lost in transit, we will not dispatch a replacement item immediately. Replacement items will be dispatched according to our discretion.

Unfortunately, we are unable to give a guaranteed time of delivery. All items will need to be signed for. By purchasing online, you agree that we have satisfied the condition where a signature has been received from the recipient, appropriate agent or proxy recipient of the order (chosen at the courier partner's discretion). This includes, but is not limited to, a receptionist signing on receipt of delivery at the specified address. You agree that in doing so we have delivered the order within the terms of the agreement between you and us.

Without limiting the operation of any other Terms herein, we will not accept liability for any loss or damage arising from a late delivery. Without limiting the operation of any other Terms herein, you agree that late delivery does not constitute a failure of our agreement, and does not entitle you to cancellation of an order. Without limiting the operation of any other Terms herein, we will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.

Returns and Exchanges
The purchaser or the recipient of a Dracakis online order may return an item that has been purchased from dracakis.com.au because you have changed your mind or are unhappy with the gift.

If you return goods via Australia Post, please keep the appropriate proof of return. Otherwise, if the returned item goes missing in transit to us, we will deem you not to have returned the item.

It is your responsibility to ensure the goods are adequately packaged to ensure that they are not damaged during return transit. A return or exchange will not be issued unless the item/s are in a saleable condition upon return.

All returned items must be:

1. Returned within 14 days of delivery
2. Unused, unopened and in original condition
3. Undamaged

In the event of a return by you or the recipient of a dracakis.com.au gift, we will exchange or refund in the form of a DJ credit note. However, you will pay the delivery costs of the return to DJ and re-delivery to you. Initial delivery will not be refunded.

Goods purchased between November 25 and 25 December can be returned until 31 January of the following year.

Goods Damaged or Faulty on Delivery
You may return damaged or faulty goods within 14 days of receipt. If a product is later deemed to be faulty, standard warranty conditions for that product apply. It is the recipient's responsibility to incur all costs and to follow warranty instructions as stated on the product warranty card, as specified by the manufacturer. In the event that you receive a defective or damaged product, DJ will refund the original product price and delivery, via the original method of payment. Alternatively, if you request a replacement, we will despatch your replacement item (subject to availability) once we receive the return, at our cost.

Accuracy and Retention
You are entitled to request access to and collection of all personal data you provide us, or to remove your name from the DJ marketing list at any time by contacting us at the following email address: info@dracakis.com.au.

Acceptance of privacy policy modifications
By accessing and using the DJ website or by submitting customer information online or at a DJ Store, you consent to our collection, use and disclosure of your information as described in this privacy policy. DJ reserves the right to occasionally make changes to our privacy policy or practices. You should therefore review these pages from time to time to receive this update information.
